Terms of Service

Welcome to Novu. These Terms of Service ("Terms") govern your use of the Novu mobile application ("App") operated by Purplecones, LLC ("we," "our," or "us").

By downloading, installing, or using Novu, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

Novu is an AI-powered design visualization application. The App allows you to upload photos and receive AI-generated transformations showing how spaces and scenes could look with different design styles.

2. Account Registration

To use Novu, you must create an account with a valid email address and password. You are responsible for:

• Providing accurate and complete information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree to use Novu only for lawful purposes. You may not:

• Upload content that infringes on intellectual property rights
• Upload illegal, harmful, threatening, abusive, or objectionable content
• Upload photos of people without their consent
• Attempt to reverse engineer, decompile, or disassemble the App
• Use the App to compete with or replicate our services
• Use automated systems or bots to access the App
• Interfere with or disrupt the App's functionality
• Circumvent any security features or usage limits

4. User Content

Your Content

You retain ownership of the photos you upload to Novu. By uploading content, you grant us a limited, non-exclusive license to:

• Process your photos through our AI systems to generate designs
• Store your content to provide the service
• Display your content back to you within the App

This license exists solely to operate and improve the service. For your original uploaded photos, this license terminates when you delete your content or account. The license for AI-generated content survives as described in the Featured Content section below.

Content Responsibility

You are solely responsible for the content you upload. You represent that you have all necessary rights to upload and use your content, and that your content does not violate any laws or these Terms.

5. AI-Generated Content

Novu uses artificial intelligence to generate design visualizations based on your uploaded photos. You acknowledge and agree that:

• AI-generated images are artistic interpretations, not professional design advice
• Results may vary and are not guaranteed to be accurate or achievable
• AI-generated content should not be relied upon for construction or renovation decisions without consulting qualified professionals
• We do not guarantee that AI-generated designs are free from errors or suitable for any particular purpose

You may use AI-generated images for personal, non-commercial purposes. Commercial licensing may be available through pro plans. AI-generated content is provided "as is" without any warranties.

Featured Content

By using Novu, you grant Purplecones, LLC a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute AI-generated images created through your use of the service. This license allows us to:

• Feature AI-generated designs within the Novu app for other users to view as inspiration
• Use AI-generated images to promote and improve the service
• Display AI-generated content in marketing materials

This license applies only to AI-generated content, not to your original uploaded photos. Featured content is displayed anonymously without identifying information.

You may opt out at any time through the Settings screen in the app. When opted out, your images will not appear in featured galleries, share links will be disabled, and your images will be hidden from other users' saved collections. This setting is reversible. If you delete your account while opted out, AI-generated images may become eligible for featuring again.

6. Intellectual Property

The Novu App, including its design, features, code, and branding, is owned by Purplecones, LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

"Novu" and related logos are trademarks of Purplecones, LLC.

7. Third-Party Services

Novu integrates with third-party services for AI processing and image storage. Your use of these services through Novu is subject to their respective terms of service. We are not responsible for the actions or policies of third-party services.

8. Subscriptions and Lifetime Licenses

Novu may offer various subscription plans, including lifetime license options. A "lifetime" license grants access to Novu for the operational lifetime of the service, not the lifetime of the purchaser. This means your license remains valid as long as Novu continues to operate.

We reserve the right to discontinue Novu or any of its features at any time. In the event of service discontinuation, we will provide reasonable advance notice to affected users. Refunds for lifetime licenses may be offered at our sole discretion, taking into account factors such as the duration of service provided and the circumstances of discontinuation.

All subscription fees are non-refundable except as required by applicable law or as otherwise stated in these Terms. We reserve the right to modify pricing and subscription offerings at any time, with changes applying to future billing periods.

9. Disclaimer of Warranties

NOVU IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Results from AI processing will be accurate or reliable
• Any defects will be corrected
• The App will meet your specific requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PURPLECONES, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF NOVU.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Purplecones, LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of Novu
• Your violation of these Terms
• Your violation of any rights of another party
• Content you upload or share through the App

12. Termination

You may terminate your account at any time by deleting it through the App settings. We may suspend or terminate your access to Novu at any time, with or without cause, with or without notice.

Upon termination, your right to use the App will immediately cease. Your uploaded photos will be deleted, but AI-generated images may be retained for use as featured content as described in Section 5.

Sections that by their nature should survive termination will survive, including the Featured Content license, intellectual property provisions, disclaimers, and limitations of liability.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or by other reasonable means. Your continued use of Novu after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of Novu shall be resolved in the courts located in Delaware.

15. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and Purplecones, LLC regarding Novu.
• Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
• Waiver: Our failure to enforce any right or provision does not constitute a waiver.
• Assignment: You may not assign your rights under these Terms without our consent.
